While it may be difficult to contemplate what to leave behind and to whom upon your passing, it is always best to be prepared in advance for the inevitable. Few people realize that death can be emotionally and financially burdensome for family and loved ones left behind. Even more so, death can be legally taxing as well. Written instructions can help; the more detailed and specific they are, the more streamlined and thorough one’s estate distribution can be.
A will is a legal document that sets out your wishes concerning how you would like your estate (real property and money) to be distributed after you die and who will be in charge to ensure that your wishes are followed through. It may also include funeral instructions and instructions on who will take care of your minor children in the event that both parents pass away.
If you die without a will, the law will decide how your estate will be distributed; therefore, making a will is something that every adult should do. Whether you have children or not, if you have assets then you need a will to control what will happen to them in the event of your death.
Normally, the process involves 2 meetings: one for discussion and instruction, one for signing. In some cases, a lawyer will be able to prepare both Powers of Attorney and your Will at the same time.
